Our Privacy Mission

Please read this Privacy Policy carefully. This policy describes the ways ADC Advance collects, protects, uses and stores your personal information on our website and in all other interactions with us, such as through our customer service channels. This Privacy Policy states our privacy practices in connection with (i) your use of this website and any mobile sites or applications operated by ADC Advance (the “User Interfaces”) and (ii) our role as servicer of Smart Home Pay application or account. This Privacy Policy is not intended to and does not create any contractual or other legal right in or on behalf of any party in addition to those rights provided pursuant to applicable law.

The following Consumer Privacy Notices describe what we, ADC Advance, and WebBank, the issuer for Smart Home Pay, may do with your personally identifiable financial information, described as “personal information” in the following Notice. In addition, we may disclose your information when the information has been converted to a format that cannot be used to identify you, as described below in the section titled “Anonymous or De-identified Data.” Subject to applicable law, we also reserve the right to transfer some or all of your Personal Information in our possession to a successor organization in case of a merger, bankruptcy, or combination with, or acquisition of a portion of our business by, another company or entity, in which case Personal Information collected by ADC Advance would be expected to be one of the transferred business assets and would be treated in accordance with this Privacy Policy.

Anonymous or De-identified Data

We may create and share aggregated, de-identified, or anonymous data from personal information by removing data components (such as your name or email address) that makes the data personally identifiable to you or through obfuscation or through other means. Our use of aggregated, de-identified, or anonymized data is not subject to or restricted by this Privacy Policy.

How we Protect your Information

ADC Advance stores and processes your information using commercially reasonable technical, physical, organizational, and administrative measures. For example, we maintain physical security measures to protect against unauthorized access to systems and use electronic safeguards such as firewalls and data encryption.

Of course, we cannot fully eliminate security risks associated with the storage and transmission of Personal Information, as no security measures are perfect or impenetrable. In order to help us in securing your information, you should choose a strong password for your account with ADC Advance, and never share your password with anyone.. If you ever receive a communication claiming to be from ADC Advance that asks for your password, you should immediately report it by contacting us at compliance@smarthomepay.com. Additionally, you should update your password and logout of any devices where you may be logged in.

Retention of Personal Information

We will retain your Personal Information for as long as necessary to fulfill the business purposes for which we obtained the Personal Information, including to provide our services and offerings, or for such longer period as may be required or permitted by applicable law. We will also retain your Personal Information as necessary to comply with our legal obligations, resolve disputes, and enforce our agreements. We use the following criteria to set our retention periods: (i) the duration of our relationship with you; (ii) the purposes for processing your Personal Information and associated legal bases; (iii) the existence of a legal obligation as to the retention period; and (iv) the advisability of retaining the information in light of our legal position (for example, in light of applicable statutes of limitations, litigation, or regulatory investigations).

What are your options?

Notifications

If you no longer wish to receive notifications about our services, including marketing communications, you may change your notification preferences by contacting us at [866-788-7942]. Note, you will not be able to opt-out of transactional notifications related to Smart Home Pay (e.g. payment due, payment made, payment past due, etc).

Opt-Out

You can opt out of future communications from Smart Home Pay. To do this you can call our support center or email us at borrowers@smarthomepay.com. The majority of our communications with you are designed to be informative of status and transactions for your application and loan.

Access your information

Some personal information can be reviewed and edited at any time by logging in to your account or by contacting us at 866-788-7942. You can also request to close your account if you do not have an active or outstanding loan by contacting us at 866-788-7942. If you close your Smart Home Pay account, your account we be marked as “Closed,” but your account information will be retained as specified above.

California Consumer Privacy Act (CCPA) Rights

If you are a California resident, then the CCPA may provide you with specific rights regarding your personal information, in addition to the rights described above.

You have the right to request that a business subject to the CCPA (which may include your Authorized Service Provider) disclose information to you about the specific pieces of personal information it has you; the categories of personal information it has collected about you; the categories of sources from which the personal information is collected, the categories of personal information sold or disclosed, if any; the categories of third parties with whom the personal information was sold or disclosed; and the purpose(s) for collecting or selling the personal information. In addition, you have the right to ask such a business to delete personal information collected about you. If you choose to exercise your rights, you also have the right not to be discriminated against and will not be charged different prices or provided different quality of services. These rights are subject to certain limitations and exceptions, which are described below.

In addition, you have the right to opt out of the sale of your personal information by a business that sells personal information. The CCPA defines a “sale” as the disclosure of personal information for monetary or other valuable consideration. ADC Advance does not offer an opt out from the sale of personal information because we do not sell personal information subject to the CCPA’s sale limitations. The CCPA also requires we state that we have no actual knowledge that we sell the personal information of individuals under 16 years of age.

Some of the personal information about you that we may have may be subject to other federal and state privacy laws and thus exempt or outside of the scope of your rights under the CCPA. For example, your personal information subject to the federal Gramm-Leach-Bliley Act (which, generally stated, is your personally identifiable financial information described above) or the Fair Credit Reporting Act is exempt from your rights under the CCPA. If you submit a request to know or delete your Personal Information under the CCPA, the information we provide or delete may not include those pieces of Personal Information subject to other federal or state privacy laws or exempted or outside of the scope of the CCPA for another reason. For example, we may not delete Personal Information we have a legal obligation to maintain it or if doing so could adversely affect the rights and freedoms of someone else.

You can exercise your applicable CCPA rights by contacting us at compliance@smarthomepay.com or (866) 788-7942. Please note that the CCPA requires us to verify the requests we receive from you when you exercise certain of the rights listed above. For example, if you have an account with us (accessible through the “Borrowers Login” link), we may require you to verify your identity by logging into your account with us. If you do not have an account with us, we may ask you to provide additional information to verify your identity before taking further action. If an authorized agent is submitting a request on your behalf, we will require additional information from the company or person submitting a request on your behalf and from you. If we are unable to verify your identity, we will not be able to respond to your request.

Cookies, Web Beacons and Website Analytics

A “cookie” is a small text file that a web server stores in browser software. A browser sends cookies to a server when the browser makes a connection to the server (for example, when requesting a web page from the same domain that created the cookie). The purpose of cookies is to remember the browser over time and distinguish one browser instance (or user) from all others. Some cookies and other technologies may serve to track personal information previously entered by a web user on the User Interfaces. Our User Interfaces and services are intended for use by individuals 18 years of age or older.
