Electronic Communication, E-Sign Agreement, and Consent to Receive Communications

Introduction

For purposes of this Electronic Communication and E-Sign Agreement (the “Agreement”), the words “we,” “our,” and “us” mean WebBank, Member FDIC, ADC Advance, and their affiliates and agents. The words “you” and “your” means the individual(s) completing this application Under this Agreement, you give us consent to provide you electronically any disclosure, notice, agreement, record, document, communication, or other information (“Communications”), including any Communication we are required by law to give you in writing.

You agree to receive electronic Communications from us.

We are required by law to give you certain information in writing. This means you have the right to receive that information physically, on paper. With your consent, we will send that information to you electronically, instead, in accordance with the federal Electronic Signatures in Global and National Commerce Act (“E-Sign Act”). By consenting to this Agreement, you consent to receive Communications in electronic form. You also consent to the use of electronic signatures in your relationship with us. We reserve the right to provide Communications in paper form at any time.

We may deliver electronic Communications to you in several ways.

Electronic Communications may be posted within the Smart Home Pay platform website and/or delivered to the email address you provided to us. It is your responsibility to keep current your contact information associated with your Smart Home Pay account so that we can send you electronic Communications. You can update your email address and other contact information from your account settings within the Smart Home Pay platform, or by contacting us at 866-788-7942.

You can withdraw your consent to receive Electronic Communications.

You have the right to withdraw your consent to receive electronic Communications. However, once you have withdrawn your consent you will not be able to request a loan from us using the website, mobile app and you may be ineligible to use or obtain any other services. If you have a pending loan request that you made using the website, we will terminate it and remove it from our system. If you have already received a loan, all previously agreed to terms and conditions will remain in effect, and we will send Communications to your verified home address as reflected in your Smart Home Pay account. To withdraw your consent, please contact us at 866-788-7942. If you withdraw your consent before a loan is issued, your application will not be processed.

You have the right to request documents physically, on paper.

You will have the right to request any Communications covered by this Agreement in physical, paper form. To receive a paper copy of any document that has been previously provided to you, please contact customer service at 866-788-7942. There is no cost for requesting paper documents. Future Communications will continue to be delivered electronically unless you withdraw your consent, as described above.

Minimum system requirements for accessing electronic Communications

To access electronic Communications, you will need certain browser and encryption software that meet these requirements. Our system requirements are:

  • A mobile device running Apple iOS 13.0+  or Android 5.0+ (Lollipop)
  • A computer capable of running a modern web browser like, Microsoft Edge, Safari 13 +, Chrome 48 +, or Firefox 68 +.
  • The ability to view and retain Portable Document Format (PDF) files.
  • The ability to receive text messages to allow for two-factor authentication
  • A valid email address.
  • Sufficient storage space to save past Communications or a means to print them.

By consenting to this Agreement, you confirm that the electronic device you use to access Communications from us meets the minimum specifications and requirements outlined above. If a change in these hardware or software requirements creates a substantial risk that you will not be able to access or retain electronic Communications, we will provide you with notice of such change.

Express Written Consent to Receive Communications

By agreeing to this and proceeding with your application, you verify your mobile number is correct and consent to receive phone calls and text message communications (“Telephone Communications”) to this number, including Telephone Communications using an automated telephone dialing system, artificial voice, or prerecorded voice, from WebBank, Member FDIC, ADC Advance, and their service providers (including the service provider for my smart home security system). By consenting to this and proceeding, I agree that such Telephone Communications may concern my application for Smart Home Pay, account servicing and collections, or my smart home security system. Message and data rates may apply.

Customer Consent

By agreeing to this and proceeding with your application, you consent to the electronic delivery of all Communications. You also consent to receive Telephone Communications regarding your application or loan via phone or email. You should retain a copy of this Agreement and all other Communications for your records.

By choosing to proceed with your application, you agree to all the above.
